The great federalism question of our time is whether or not it is constitutional for the federal government to force Americans to purchase a private product, in this case private health insurance. I filed suit on your behalf to challenge this unprecedented power grab by the federal government, and we won the first round in Judge Roger Vinson’s federal district court.
Everyone knows this case will ultimately be decided by the U.S. Supreme Court. Judge Vinson stayed his order striking down the law, allowing continued implementation of the law’s provisions that have taken effect, but he ordered the Department of Justice to act quickly on its appeal, writing “The sooner this issue is finally decided by the Supreme Court, the better off the entire nation will be.” The responsible thing to do, while tax dollars are being spent to implement health reform, is for the administration to ask the Supreme Court for expedited review of the case so that this issue can be resolved without needless delay. I hope Governor Gregoire will join me in calling for expedited review so these important constitutional questions are settled sooner rather than later.
